Source Licence Terms

This details the terms of the SOURCE licence that you, the Customer,
have purchased directly or indirectly from us, ExNet Systems Ltd for
use of the software package called dhdsftpd V1.1.

 1) Firstly, you are bound by all the terms of the accompanying RTU
    (Right-To-Use) licence for dhdsftpd.

 2) In particular, you are only entitled to use as many copies of the
    executables and documentation as you have purchased RTUs.

 3) You may not incorporate elements of our source code into any
    software of your own without our explicit written permission; the
    rights remain with us.  We are granting you a source licence
    primarily so that you can check the integrity of the software
    system we are supplying you with.

 4) If you make any modifications to the source code you must pass
    those modifications back to us.  In particular we wish to be able
    to pass security fixes to other customers as quickly as possible.
    We will give special consideration to changes that you feel would
    be bad for your site if passed to other users of the software, but
    ultimately the decision rests with us.

 5) You may not publish any of our source code to any third party
    without our explicit written consent, and in particular you may not
    resell or pass on a source licence since source licences must be
    directly between the end-user and ExNet Systems Ltd.

 6) Remember, you do not own the source; you have a limited right to
    read and modify it.

 7) You may not disclose details of the internal functioning of the
    dhdsftpd software to any third party where that would allow them to
    reverse-engineer the software or use security or other flaws in
    dhdsftpd.

 8) Our liability is strictly limited to the recommended retail (list)
    price of the software or the price you paid for it, whichever is
    the lower.  WE ARE NOT LIABLE FOR CONSEQUENTIAL LOSSES UNDER ANY
    CIRCUMSTANCES.
    
 9) If you do not accept these terms, we do not allow you to use the
    software and you must return it immediately, unused, to us.

10) You agree to submit to this agreement when you remove the software
    from the packaging it was supplied to you in, or execute any
    component of the software on any computer or examine the contents
    of any of the paper and electronic files and documentation that is
    part of this software package other than this licence agreement.

11) You may cancel this licence at any time by sending a notice to us
    and your suppliers (where possible) in writing confirming that you
    have destroyed all copies of the the software and related files and
    data.  Your RTU licence and source licence and all other licences
    for the appropriate copy or copies of the software are then
    terminated.

12) If any clause of this agreement cannot be enforced in law it shall
    be deemed struck out and the other clauses shall still stand.

13) If ExNet Systems Ltd cannot fulfill any part of this agreement due
    to circumstances beyond its reasonable control (including, but not
    limited to, industrial action, natural disasters and Acts of God)
    it shall not be liable in any way for those failures.

14) This agreement is governed by the laws of England, and both parties
    agree to submit to the jurisdiction of the High Court of England,
    though ExNet Systems Ltd may enforce this agreement in any court of
    its choosing.
